What will the outcome be in the Marks and Spencer Tea Cake tax blunder?

For 20 years, customers have paid tax on Marks and Spencers tea cakes, but the European Court of Justice has now ruled that it is officially a cake (really?!) rather than a biscuit and therefore not subject to tax. So the UK treasury is facing the prospect of repaying £3.5m in wrongfully collected tax. The decision will lie with the House of Lords.

Yes, there should have been an "Other" option I guess. If it's reported that they donate part of it to charity, then it will be settled as either outcome Green or Yellow, depending on whether it was full or partial repayment.
