The final charge does not have to be "smoking in public" -- any similar charge that incorporates and/or results from his alleged smoking will suffice.
If the charge(s) are dropped or withdrawn, this will settle as "No".
Any form of plea bargain shall be settled as "Yes".
A change of plea to, for example, "No Contest" or "Not Responsible" shall go forward, and if found by the court as anything but "Dismissed" or "Not Guilty", shall be settled as "Yes".
Any appeal of a final finding by the court shall have no effect on the settlement of this market.
If a finding in this case is not made by December 31, 2009, this smokin market shall be voided, and all the hundreds of thousands of H$ invested in this market shall be returned.
