However, prosecutors have charged him with a felony. The law has been rarely enforced in the last 80 years. The maximum sentence is up to 5 years in prison and a US$10,000 fine.

Just to clarify. Any fine or any prison sentence will cause settlement to be one of the first three options. He does not need to receive the maximum.

If, say Sanders receives a year probation, and is ordered to pay (court) costs, will that be considered a fine?

BTW, this was an issue, of sorts, with the question "Will actor Shia LaBeouf be found guilty of smoking in public?"

LaBeouf paid a $500 fine in exchange for having the charges dropped. Some published reports referred to this as "court costs".
