If at the end of the regular season a given team is tied exactly, (based on winning percentage), with another team for the lead of their respective division that team will be considered as NOT leading their division.
If for whatever reason a given team's regular season has not ended on SEP 28, 2008, and the completion of the regular season has an impact on the outcome of this question, then the question will not be settled until the regular season does end.
