Supreme Court Justice Ruth Bader Ginsburg said Friday that there will "soon" be an opening on the high court, prompting widespread speculation over whether the justice has plans to resign.

Ginsburg made the comment Friday in Boston in her first public appearance since undergoing cancer surgery last month.

A student at the New England Law School asked Ginsburg to explain how the Court's dynamic changes when a new justice arrives. Ginsburg — who turned 76 on Sunday — said the Court only takes a group picture when a new justice arrives, adding, "we haven't had any photos for some time. But surely we will soon."

Ginsburg's comments were first reported by the Associated Press and then posted to numerous legal blogs.

Ginsburg's recent health problems would certainly give her reason to retire. But in a newspaper interview last week, she reiterated her desire to remain on the Court for several more years. Ginsburg's provided no further explanation Friday about her comment.

John Paul Stevens and David Souter are two other justices rumored to step down. Stevens will turn 89 next month, but has shown little sign of slowing down. Earlier this month, Stevens intently questioned a lawyer in a high-profile judicial recusal case. And the justuce remains a powerful force behind the scenes — having already authored several significant opinions.

Souter, 69, is well known for the fondness he has of his New Hampshire home, where he spends his summers. The justice described the annual return to the Court's business in the fall as "sort of annual intellectual lobotomy." Souter's appearance last week at a humanities conference in Washington, D.C., was itself noteworthy for the dearth of public appearances he has made in his nearly two decades on the bench.

On Friday, Ginsburg called Souter a "slave to duty," but said she was able to coax him into joining her for an evening of opera at the Kennedy Center in Washington. Ginsburg said his attendance was a demonstration of support in the aftermath her cancer surgery.

Justice Souter to Retire

Supreme Court Justice David Souter is set to retire from the Supreme Court when the current term ends, NPR is reporting.

Earlier in the day, the Associated Press had the legal word buzzing with a story that hinted at Souter's retirement due to the fact that he has yet to hire any law clerks compared to the other eight justices who have each hired their four clerks. Why does this matter? Under the scenario that counts, Souter, 69, would not be hiring clerks because he isn't planning to be in Washington in the fall. A retirement would give President Barack Obama his first chance to nominate a justice and the next few months would bring Senate confirmation hearings.

Copying a flag from super Superuser Ondave: "This settlement can get confusing. The last time a Supreme Court Justice was replaced, Sandra Day O'Connor announced her resignation. Then William Rehnquist died. O'Connor postponed her resignation until the second new Justice could be confirmed."

Thus, I think this one will likely wait to settle until a justice is actually replaced and not merely settle on the announcement of Souter's intended retirement, esp with Ginsberg's much publicized cancer...

Personally, this should have been suspended yesterday, or these questions should have to be worded differently.... of course they're going to announce a replacement months in advance....and if we're going to allow it to go to 99% at least 6 months before settlement or suspension, then it should have just been settled, based on the "99%) rule.... it bothers me that supers are able to make big money on these questionable suspension dates..... i voted on other candidates after the announcement to make the point.... i have $20 on someone else.... and i stand to make a lot....but a lot of people had legitatimate bets, and now they are screwed, unless something really rare happens.... and supers have bet on this early in the process and stand to make a great deal of money.... notwithstanding any previous issues, supers and admins should be held to a higher standard....
