Will the Spore anti-DRM lawsuit against EA proceed to trial and receive a verdict on the merits?

Please note that any post-trial motions, such as judgment not withstanding the verdict, or motions for new trial, will not affect the question. Also, whether the decision is favorable to a party or not will not affect the question (i.e., doesn't matter who wins).
Remember contestants, that most lawsuits settle, or are dismissed, or are decided as a matter of law (not on the merits) under summary judgment. It's actually rare that a case is decided on the merits. Keep that in mind when placing your bets.
Settlement details:
As reported by a major mainstream news source if the disposition of the case is clearly stated (i.e. how the case was resolved); or as reported by GamePolitics.com or GamesLaw.net, or as reported by a searchable order of the court in either PACER, Westlaw, or Lexisnexis.
