Will the Spore anti-DRM lawsuit against EA proceed to trial and receive a verdict on the merits?

EA has been sued over the DRM (especially Securom) in Spore. Will the suit proceed to trial and be resolved on the merits with a verdict? Please note that this is a legal question. For the answer to be yes, the suit must not settle, it must proceed to trial, it must not be dismissed by any pre-trial litigation, and it must be decided on the merits. Therefore, settlement, a motion to dismiss, or a motion for summary judgment, will result in a "No" answer. Only a verdict from the jury, or a successful motion for a directed verdict will result in a "Yes" answer.
