Will Licking Valley teen be registered as a sex offender for sending her nude pics to classmates?

Settled as No

Due to a settlement made with the state the girl will not have to register as a sex offender
http://www.upi.com/Top_News/2008/10/21/No_sex_offender_status_for_phone_pics_girl/UPI-27751224639408/

Background:

Background: You can't make this stuff up.

A 15 year old student at Licking Valley High School in Newark, Licking County, Ohio has been charged with "possessing criminal tools and the illegal use of a minor in nudity-oriented material" for sending naked pictures of herself to friends via her cell phone.

The girl "had already been warned by school administrators about [what he called] "inappropriate cell phone behavior." "

Sounds funny? Well, maybe not so funny for the unnamed young woman. If convicted in juvenile court, she faces possible probation, juvenile detention center time, and, at the discretion of the judge, could be made to register as a sex offender.

And before you yell out that old Digg cry of "Pics or it didn't happen", the Licking County prosecutor is considering charges related to child pornography against the classmates who received the photos via their cell phone.

Only in Licking Valley. (I mean, what do they expect with a name like that?)

ABC News Oct 10 story

This question settles as Yes if there are reports of her being added to the Ohio sex offender registry related to this case before April 1 2009 (naturally), regardless of any other results of the charges. If there are no such reports, or if it's reported that all charges are dropped, or that the judge doesn't make her register, it settles as No.

Settlement details:As reported by a major mainstream news source.

I remember a few years ago a 17 year old guy got charged here in Australia for possessing child pornography because he had naked pictures of himself.

"This isn't the first case in which zealous American prosecutors have used child pornography statutes to protect vulnerable juveniles from themselves. In 2004, a 16-year-old girl and her 17-year-old boyfriend took pictures of themselves while naked and engaged in unspecified "sexual behavior." They didn't show the pictures to anyone, but they did send them to the boy's email address.

Eventually each was charged with producing, directing, or promoting a photograph featuring the sexual conduct of a child. The boy was also charged with an extra count of possession of child pornography. As CNET News reported here, the girl's conviction was upheld last year on appeal.

I'm all for protecting minors from predatory adult behaviour, but this is just nuts.

Only in America, only in America. Actually at my Junior High School, some guy sent out nude photos of himself to every student on his email, he was trying to send it to one person but he fouled up big time. He didn't need to be punished, due to the shame he brought on himself.

If you ask me this is a gross invasion of personal rights. This doesnt make her a sex offender. This makes her a whore. If you lock her up for anything lock her up for prostitution!

Sounds like you might be holding resentment from possibly boring high school years. ; )

...... I said there claims are false and that she shouldnt be locked up for being a sex offender. How does that make me sound like i have "resentment"?

giving her boyfriend some pics doesn't make her a whore.

I see it was more than her boyfriend, still, not a whore. Exhibitionist would be the appropriate description.

I'm reminded once again of the old adage "If it looks like a duck and it walks like a duck and it quacks like a duck its a duck." Same for this girl. "sending naked pictures of herself to friends via her cell phone." It says freinds. As in plural. Not just a boyfriend (which would be wrong for a girl of that age but hardly illegal.) friends. If you had a daughter and she showed herself naked to multiple people what does that make her? A whore. Once again probably not illegal but wrong all the same.

this is the sort of behavoiur that will come back to bite you in the ass one day, especially if your boss gets a hold of the photos (hell, the embarassment of that alone doesnt bear thinking about)
