Background:

A case that challenges President-elect Barack Obama's name on the 2008 election ballot citing questions over his citizenship

has been scheduled for a "conference" at the U.S. Supreme Court.

Conferences are private meetings of the justices at which they review cases and decide which ones to accept for formal review. This case is set for a conference Dec. 5, just 10 days before the Electoral College is scheduled to meet to make formal the election of Obama as the nation's next president.

The Supreme Court's website listed the date for the case brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, over not only Obama's name on the 2008 election ballot but those of two others, Sen. John McCain and Roger Calero.

This will suspend on December 4th. Will settle after the U.S. Supreme Court makes their decision.

my orignal was voided "It has been reviewed by one of our experienced category editors they've decided that as it stands it doesn't quite fit our guidelines" with the suggestion of starting odds at 75 or 80. imho they will take the case. i wanna wager but can't. to much at stake not to have the case heard. it will take obama 5 minutes to settle the case.

i don't know what to say on that curios. is it fair to restrict admins and superusers from making wagers? should they be a time limit as you suggest? maybe you can start a forum topic and get feedback from other users. i don't know how HD works as far as when a question is created do all the admins get a notice?

they vet them within 6 hrs now, it used to be twelve. the idea was it stops any creator gaming when they have been vetted the say you as the creator can wager, but then at a later date some one may find a reason to suspended or even void it, which really should not be allowed.

Love this question man but I think you may have have set the odds the opposite way ryanj wanted. He said:

I took that to mean 75-80% chance of the event occurring. Hope it isn't voided... again.

LOL Dieseldog she is pretty hot but even she can't take the Hubdub out of me!

I was the one who voided the market guys, thought the odds were just too low. Usually when reviewing markets there's an unwritten rule of giving market odds about a 15% leeway on both sides. So going with 75% is just fine. This market won't be getting voided unless the Court gets blown up or something... Actually if that happened it would just settle as 'no - U.S. Supreme Court does not hear the case.'

curios - i see another admin and a superuser has made a bet. i'm guessing they read the comments. if an admin don't get a notice when a new question is made i see no reason to make them have a delay in betting on a question. destry just happen to catch the question when it first got published and made his wager. all's fair in love and war. if the SC takes the case he helped me make money. if they don't he'll make money.

elected by the people is the key part...in 2000 and 2004 people who were elected by the people did not become the president...there is precedent here.. I will say the supreme court is just right winged enough to hear the case!

A president takes the oath like this:

"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

How can the Supreme Court Justice stand idly by, knowing that the person mouthing those words is perhaps trampling on the Constitution by that very act?

Just a small simple little detail here : US citizenship is a birthright no matter what country you are born in as long as one or both of your parents are U.S. citizens. Last I looked Obama's white momma was a U.S. citizen..so what is all the fuss about anyway? It doesnt matter if he was born in Kenya, or Kentucky or hawaii or Mars. long as mom or dad was a US citizen he is

It is my understanding that you have a right to claim citizenship if your birth parents are US citizens. But you are not automatically considered a citizen (with citizen's rights). In some cases you must "establish" this.
An example :
A US soldier (using a male as an example) fathers a child with a non US woman and then returns to the states. This child grows up never knowing their father and discovers he was a US citizen, the child has a right to claim citizenship, but there are steps to take to establish this.

That policy is called "Jus sanguinis" and there is a whole body of law that addresses that issue. The laws change from time to time, and are not altogether straight-forward. The individual in question would have to consult the law as it stood at the time of his or her birth to determine what was applicable.

Here is how the U.S. Citizenship and Immigration Service explains the difference:

"The 14th Amendment of the U.S. Constitution guarantees citizenship at birth to almost all individuals born in the United States or in U.S. jurisdictions, according to the principle of jus soli. Certain individuals born in the United States, such as children of foreign heads of state or children of foreign diplomats, do not obtain U.S. citizenship under jus soli.
Certain individuals born outside of the United States are born citizens because of their parents, according to the principle of jus sanguinis (which holds that the country of citizenship of a child is the same as that of his / her parents). "

to my knowledge obama has one parent a usa citizen and the other is not. so it boils down to where he was born and what the parents had written on the birth certificate. i'm guessing the male is the dominate gender in obama's father's society. he mighta said i want my son to be a keyna citizen and thats what they put on the birth certificate. then theres the "duel citizenship" deal that makes it even more cloudy. i'm no laywer so i can't figure it all out. this is the reason the SC should take the case. if obama has a legit birth certificate saying he was born in the usa, and it says he's a USA citizen why not show it? instead he spends money fighting it in court. that raises a flag in my mind. if somebody took me to court saying i don't have a HD account..i would login in and say there ya go. i wouldn't spend money and time saying yea i got one, but ain't gonna prove-show it to you. i guess since he ain't spending "HIS" money he don't care.

The question is not whether or not Obama is eligible to be a citizen, it is whether or not he is eligible to be President. Gov. Arnold Schwarzenegger for example. He's a citizen, a Governor, and is not eligible to be president.

Here is the situation as I understand it:
Obama's father was not a US citizen. His mother had only been a citizen for 2 years when he was born. He also MAY have been born in Kenya. Since his father was not a citizen and his mother had not been a citizen for long enough, IF he was born in Kenya then he would not be eligible to be President. All he has to do is release his original birth certificate to prove that he was born in Hawaii and is therefore eligible to be President.

Why would anyone say his mother had only been a citizen for two years....she was born and raised in Kansas (the most American of all the states) and had Obama at a relatively young age...probably before she could have 'renounced' citizenship even if she had ever wanted to do so. Additionally, there is no evidence of any kind that he was born anywhere other than Hawaii, which WAS a state at that time and that birth automatically grants citizenship.


It just seems to be a bunch of crap thrown out to try to confuse and mislead...and embarrass as well, I suppose.

Perhaps it has something to do with the fact that "Indonesia does not allow dual citizenship"? I would be careful before accusing people of making stuff up - I don't understand all the details, but it is obvious that he came from a very unconventional family history, and there are a lot of angles to consider.

My concern is for our country and the dissolving sovereignty. As a lifelong conservative, I voted for Bush both times. However, he has done more to steer me towards the democratic party than any other person alive. He completely lost me when he refused to secure our southern border in favor of allowing illegal immigrants to come into our country unabated.

Neither McCain or Obama would talk about the millions of illegal aliens in our country, which places an unfair burden on health care, education and law enforcement. I believe in the constitution and want to see it upheld. The 14th amendment addresses qualifications to be in office and it is fair to ask that we abide by it.

I read it again - I believe what the issue is the number of years that the american parent had lived in the the United States after their 14th birthday, and before the birth of the child. Barack's mother was too young to qualify, if he was actually born outside the country. (This prevents, say, a bunch of soldiers who were drafted at 18 years old from going to Viet Nam, or somewhere, and creating a bunch of US citizens.)

So...this is getting confusing....are the people behind this saying that he wasn't born a US citizen and are wanting his birth certificate for that purpose, or are they saying that as a minor child there may have been some conditions regarding his citizenship and his stepfather...or are 'they' just searching for anything to invalidate the election?

I think that most of the American people are satisfied with his background and the results of the election year.

I agree that he comes from a most unusual family background and history...but what do you want? Just to drag this out and on and on? Let's move on!

Considering the fact that:
Mr. Obama as an american citizen surely took a civics class and knows that a naturalized citizen (one who is not a US citizen by virtue of a birth right) may not be President of the USA.
Now Mr. Obama knows as well as all of you, that his mommy is a US citizen. We all know his mommy is a US citizen. We all know she was born in the middle of Kansas. The Wizard of Oz did not plop his momma down there.

In that knowledge what is there to be proven? Oh I know he has to prove that his mommy gave birth to him, and he was not switched at the hospital, raised my his mommy and grand mommy and granpapa all by mistake.
We will assume when he travelled this past year on his European tour he had neither visa nor passport and just got there via name recognition and facial recognition.
We will assume when he was of age many many years ago, he did not need to show a single piece of birth information like a birth certificate to get his driver's liscense.
We will assume all those years working and filing taxes he never had to show his birth certificate to get a social security number.
We will assume he has never ever had to show identification of any kind for any reason cause he is Obama and since the day he was born he decided he would pull this hoax off on America!
And we will assume that for the past 2 years under severe public scrutiny by every newscaster in the world, by every crawl out from under the woodwork bigot, by every political foe including miss hillary, and every white supremist organization in the country...he has been able to get elected president without ever having a social security number, a birth certificate, a passport, or know for sure who his momma was or if his momma was a u.s. citizen. And not a single soul cept this wacko can prove it.
Ok i am going to click my red heels and say: There is no place like home, there is no place like home! And beleive that i will end up in Kansas, Santa Claus will pop down the chimney, and reindeer really do fly, and George Bush is a Rhodes Scholar because the later has a much better chance of being true than Obama not being a citizen.... While I "Thoreauly" enjoyed your answer - I also find the whole question of constitutionality fascinating. Do I personally think he should / would be replaced as President if it is found that his citizenship status is questionable? No No No.
There would be rioting in the streets - literally.
However, there are 17 different lawsuits regarding this issue, including one from a man I would like to see in office - Alan Keyes.

If this happens, the rioting should be focused on the MSM and the DNC for failing to properly vet their favorite candidate... if I was a liberal, I would be seriously ticked off at the dismal choices offered... although as a conservative I was ticked off that there was no conservative to vote for... in a way, the MSM does me a favor digging deeper into the background of conservative candidates... most elections I know exactly what I'm voting for...

Liberal voters didn't have that luxury. They had to vote for Obama without access to: his Occidental College records, Columbia College records, Columbia Thesis paper, Harvard College records, Selective Service Registration, Medical records, Illinois State Senate schedule, law practice client list, Harvard Law Review articles published, University of Chicago scholarly articles and Illinois State Senate records.

Even his Republican friends could not swallow that complete act of incompetence. October 28 is the day the press turned, until then for 4+ years the only negative press reports you will find are written by the Arizona Republic..and those terribly extreme left wing commie papers like the nation, politico.org, moveon....but really that is like preaching to the choir...no one but left wingers read that stuff.

Media outlets such as the Washington Post spent time on vicious rumors about Trig Palin's birth, (the son of a Vice Presidential nominee - he was not even running for office), but could not find curiousity about Barack Obama's birth - the Presidential nominee of their favored party.

I will apologize now. In hindsight, it was not very interesting to read the many references to Obama as a Rockstar. But to claim that this was a republican ploy to try and give bad press by association is absurd. Same for the claim that McCain received as much or more positive press than Obama. If you believe that, then we are going to have many interesting hours of pointless banter. (But I really do appreciate the tone of this conversation so far - for some reason, many liberals take it personally when they debate. ie "Joe the Plumber should be killed" uttered by the radio DJ when he forgot about hot mikes.

Do you really think that the main stream media is in the grip of the right wing of politics? MSM is a large reason Obama won the election, along with a suddenly tanking economy. They were solidly in his camp and were his largest cheerleaders when it came to "presenting the news".

As for the National Enquirer - they were right on target with John Edwards having a mistress. If Obama is so squeaky clean, I wonder what they are hiding by not releasing his many records. . .

I really beleive that the main stream media is in the ownership and grip of conservative, rich white men...aka republicans...all you have to do is look at the CEo's board of directors of corporations and look at the membership roles of the republican party..this does not take a scientist to do.

We the people of the United states were not for the first time dependent upon the "Main Stream Press' for the news. Do you remember in journalism class when they talked about the early newspapers and how to sell papers the publishers would invent stories? Wild crazy stories to get people to spend a penny?

Good god as old as I am..my mother was on the internet googling and checking out palin, and mccain, and obama, and watching you tube; cursing the fact that the keyboard keys were slower than her old royal typewriter.

People have access to instant information..what we could access 4 years ago is not as great as we could access yesterday is not as great as we can access today.
This is what made the difference in the election.(seting the better man argument aside)...and it caught the main stream press by the (excuse the expression) short hairs; it caught mccain by them..and the republican party.
How many people "watched the debates on tv" but simultaneously were online...googling the facts the candidates were spewing...u think u were the only one?

How many people were studying electoral maps, who 4 years ago did not know what an electoral college is? Or still dont.

what people ain't taking into consideration is no matter where obama was born if his parents didn't make him a USA citizen on the birth certificate then he isn't eligible to be prez. not all people wanna be a USA citizen. if people wanna say it's ok if obama isn't eligible just move on thats their right. it doesn't change the law. no matter how well he speaks and makes people feel good he has to play by the same rules everybody else does. if all obama supporters are so sure he's eligible why don't you want him to show his "ORGINAL" birth certificate? who's dragging this out? obama is..if he wants to unite the country show the birth certificate and put it to rest. i know most of you won't believe me, but i truly hope obama is eligible. with all this country faces the last thing we need is a even more divided country with rioting in the streets.

Now you kind of know how we Democrats felt eight years ago when we believed the election was stolen from us. Rest assured, our new President's mother was born in Kansas and our new President himself was born in Hawaii. You can let this one go, and maybe move on to something more productive.

Just a simple caveat: I work very long days (12 hour shifts) and being the old man that I am, I come home tired and grumpy. When I post messages in that frame of mind, I come off sounding like a bitter angry person. So please understand that I refrain from posting on a frequent basis.

Ownership does not equal operation or management. It is quite easy to google media studies about the validity of liberal bias in the news. Far fewer studies claim to find conservative media bias in the main stream media.

Fox news has a solid viewership because of their conservative bias, not because they are better than any other network. (Admittedly, their viewership is quite a bit smaller than the major networks on MSM). They offer a news & opinion forum that is unique because it does not cater to the liberal media bias.

Very few people will actually try to make the argument that the media has a conservative media bias - and when they do, it is like shooting fish in a barrel to defeat their self serving preconceptions.

Segue back to the topic of this thread:
Notice how little attention is given by the main stream media about this issue. If it were simply run by and for republicans, then this would be a daily staple in the newscasts.

Notice how the arguments are being laid out. Somebody says that Obama might not be a naturalized citizen because his birthplace is disputed and that somebody is quickly called names or made fun of, in some fashion. The argument is not disputed on it's merits, but the messenger is shot down instead. Currently, the democratic party is spending big money to prevent the display of a $12.00 birth certificate.

The longer the Obama machine resists showing his birth certificate and school records, the more I am convinced that he has something to hide.

Yes, I would hesitate to do so because no president in the history of the states has been asked to do such a ridiculous thing, and being a Constitutional lawyer, Obama understands the concept of legal precedent. In his particular case, if he starts trying to "prove" that he's a citizen to the seven loons who are pushing this caca forward, the'yll ask for something else, something else, and something else. There is absolutely no reason to produce an "original" birth certificate given that a certified copy has been made available and the clerk in Hawaii has said it's legitimate. This whole thing is right up there with the Jewish 9-11 conspiracy and the rest. Get over it. Obama won. He's black. Again, get over it.

Are you a native born citizen of the USA? Your profile says you're from Mexico. Maybe you should concentrate on making the tap water drinkable before you guys try to tell us how to run our country. Several people (including his grandmother and an ambassador) have claimed that he was born in Kenya. Maybe, just maybe, someone should enforce the requirements to be President. But like I said you guys have more pressing matters to deal with down there.

Arnold is a US citizen - he has been naturalized. That is the point here: a naturalized citizen is not elegible to be President either. (And I am guessing not many Rs are proud of Arnold either, but that is another topic :-) )

Court delays action on suit

The Supreme Court held off Friday on deciding whether to grant a hearing in a long-shot lawsuit that would decide whether Barack Obama can constitutionally become president as a "natural born" U.S. citizen.

The Friday list of court orders that denies or grants hearings did not mention the lawsuit, which says Mr. Obama should be disqualified from the presidency because he purportedly acquired the same British citizenship that his father had when he was born.

A spokesman for the court said the decision on whether to hear the suit brought by retired New Jersey lawyer Leo Donofrio is likely to be announced next week.
