Dallas Stars left wing Sean Avery has been suspended indefinitely by the NHL. However, the suspension was not for a common reason like fighting or drug use. Avery was suspended for "inappropriate public comments, not pertaining to the game." He referred to ex-girlfriend Elisha Cuthbert as his "sloppy seconds." Avery has missed two games since his comments.

Cuthbert is currently dating Calgary Flames defenseman Dion Phaneuf. She has also dated Mike Komisarek of the Los Angeles Kings. Cuthbert stars on 24. She also appeared in Old School.

Avery also dated Rachel Hunter, who is currently engaged to Jarrett Stoll of the Los Angeles Kings. He is scheduled to meet with NHL commissioner Gary Bettman on Thursday to discuss his suspension.

When I saw his comments on the news I couldn't believe he got suspended. I still don't understand why a statement (especially a true statement) got him suspended. Doesn't he have freedom of speech? Isn't this a violation of his constitutional rights? In my view, punishing someone for exercising their constitutional rights is a serious crime.

I think that the suspension is more for his past actions than for the Cuthbert comments.

He used the wrong choice of words. As he always seems to do. If he would of said ex girlfriends rather then sloppy secounds he wouldnt be in the position he is in.
I think a fair penalty would of been allowing him to play last night and let Phaneuf lay him out. Not a big Avery fan anyhow i personally could care less what happens with him.

He was not hired by the Federal Government. The constitution does not apply to private industry like that. He is free to say anything he wants, and they are free to hire anyone they want. The first amendment only guarantees he will not face Federal discipline for what he says.

Would it be ok if the NHL owned slaves because they are a private company (13th amendment)? Would it be ok if the NHL searched your home and seized everything they didn't think you should have because they are a private company (4th amendment)? The way I see it, the government has a responsibility to ensure that the rights of it's citizens are not violated by anyone or any organization.

He made the comments in Calgary, Canada. The last I heard Canada was not subject to the US Constitution or the Bill of Rights.

I believe the NHL is American owned. It's the actions of the NHL that are despicable not Avery's words.

I know you were probably just typing fast, but you seem to be advocating the right to hire or fire at will be taken away. That amounts to stealing from the business that hires or fires. The 4th amendment does not apply to the NHL - I think you know that. It applies to the Federal Government. The NHL already search through your bags when you attend a game - and sieze food and drinks that are being brought in from outside the arena.

i know nothing about hockey...from the news i've seen its kinda like a dennis rodman type deal. the guy has pushed the envolope one to many times. he must be really ornery and the NHL was looking for an excuse to hammer him. i agree with pullover, kinda a stretch for the NHL to punish him. let the team fine/punish him.

Having the League punish Avrey is more of a punishment then having the team punish him. I have been watching hockey for 21 yrs and i never seen a player talk about anouther the way he does. From making racist remarks to George Laraque who is a black player. To looking like a total ass in the playoffs and waving his stick and dancing around in front of Martin Brodeur. Its about time something is done with him he is embarassing to the game. As for the Dallas Stars there coach Dave Tippett said " I find it hard to believe that Sean can come back in the dressing room and find continuity again ". Sounds to me like the team has already givin up on him and who can blame them.

According to most of what I've read, Sean Avery received a Six Game Suspension by the Commissioner, however Dallas has already dismissed him from the team, so he will not be coming back to Dallas to play and most likely not be playing hockey again. When the league is working on creating a positive image to have someone that's so polarizing like TO for the Cowboys, it's just better to get rid of them then have them tarnish the NHL's image. Which NHL and Teams and Coaches have that option.
