Will Demjanjuk be deported to Germany?

Settled as Not during April

Demjanjuk has not yet been deported and it's past April

Background:

Background: The Cleveland-area man accused of helping to kill 29,000 people at a Nazi death camp in Poland will be deported to Germany this weekend, officials said.

John Demjanjuk, 89, is scheduled to leave Sunday and arrive in Germany Monday to face charges that he walked Jews from rail cars to the gas chambers at the Sobibor camp in Nazi-occupied Poland,

Demjanjuk filed an emergency motion Thursday in U.S. Immigration Court in Arlington, Va., to stop the deportation, alleging it would amount to torture because of his age, deteriorating physical and mental health.

Why was this settled? News reports say that the deportation could still happen during April: "A decision could take anywhere from days to a few months."

right, sqlman, that's exactly why I created the question with three options: considering the possibility of a delay because of his allegations. the way this is been settled, I could have just used the two options "Yes, as planned on Sunday, April 5" and "later".

Hi All,

Just want to make a more visible explanation of why the market was reopened. I stupidly settled the market early after reading an article which led me to believe the Nazi guard was going to stay in the US indefinitely. This has turned out to be incorrect, therefore I encrourage all those who had been forecasting on this market to re-predict as the initial stakes were voided.

Apologies,
Ryan

Not so fast...

CLEVELAND - The return of alleged Nazi death camp guard John Demjanjuk to Germany for trial on war crimes was delayed again Tuesday by a federal court, shortly after six immigration officers removed the retired autoworker from his suburban Cleveland home in a wheelchair.

A three-judge panel of the 6th U.S. Circuit Court of Appeals granted a stay until it could further consider Demjanjuk's motion to reopen the U.S. case that ordered him deported, in which he says painful medical ailments would make travel to Germany torturous.

"His conviction for crimes against humanity was later overturned by Israel's highest court in 1993 due to a finding of a reasonable doubt as to whether Demjanjuk really was "Ivan the Terrible", and he was returned to the United States." If the Israelis let him go there has to be some serious "reasonable doubt". If they thought he was Ivan the terrible we wouldn't have this question to bet on :-)
posted 29 weeks ago
To my understanding it's not only about being "Ivan". I think it's pretty clear that he wasn't Ivan the terrible, but nonetheless is responsible for the death of thousends.
(Still curious that the Israelis let him get away.)
Moreover, the US institutions are not dealing with his guilt, but only with his capability of being transported to Germany, right?
Today the US Department of Justice sent a note to the responsible court... I'm still hoping for April :-)

Video of John Demjanjuk shows him walking without assistance

Videos of John Demjanjuk walking briskly indicate he is healthier than he has claimed and is fit to be deported to Germany for helping the Nazis kill Jews, federal prosecutors said late Thursday.

Prosecutors released tapes that show the 89-year-old Demjanjuk getting in and out of a car without help -- a contrast, authorities say, to the man who groaned in apparent pain as agents carried him from his home April 14 in a wheelchair.

This could well be a very close one. What if they put him on a plane on 30 April and he touches down in Germany on 1 May? Ah, sorry just saw it: Settles "yes" on departure towards Gerrmany.

Pictures that show accused Nazi war criminal 'Ivan the terrible' is fit to stand trial
http://www.dailymail.co.uk/news/worldnews/article-1173174/Revealed-The-pictures-accused-Nazi-war-criminal-Ivan-terrible-fit-stand-trial.html
Just weeks ago, suspected Nazi war criminal John Demjanjuk was pictured being carried out of his Cleverland home too frail to even walk or face trial.

But as these pictures claim to show, the 89-year-old is fit to be extradited to Germany where is he accused of more than 29,000 counts of accessory to murder.

Demjanjuk's lawyers claimed earlier this month the extradition amounted to torture because of his ill health.

But the U.S Department of Justice called on a court to lift a stay of deportation against him, arguing he was fit enough to travel.

Prosecutors today submitted videos of Demjanjuk to a federal appeals court that show him walking and talking animatedly.

They claim the video shows a contrast from the frail elderly man who groaned just days ago as agents carried him from his home.

His family says he is bedridden and suffers from a host of ailments including kidney disease, arthritis and cancer which makes him unfit to fly.

Earlier this month, Demjanjuk won an 11th-hour reprieve when the court stayed his deportation shortly after he was carried out of his home in a wheelchair to be put on a flight to Munich.

U.S. court clears way for Demjanjuk removal

CHICAGO, May 1 (Reuters) - A federal appeals court cleared the way on Friday for U.S. authorities to deport accused Nazi death camp guard John Demjanjuk to Germany, dropping a stay that halted his removal at the last minute two weeks ago.

"The U.S. Government will continue to seek the removal of Mr. Demjanjuk to Germany," a Justice Department spokeswoman said, and refused to comment further.

But there was no indication when U.S. officials, frustrated in their last attempt, would again move against Demjanjuk.
