It seems that there may be multiple correct answers.....
ie: As worded, if a female Jew were confirmed, #1, #4 and #5 would be correct.

Even more interesting: a Latina woman would count as #1 and #2. I guess a Latina transvestite or cross dresser would only count as #2...

In that event, a Latina with a hysterectomy is a #2? Or a #1 and #2? But on the other side, there is no category for a castrato, or a guy with his tubes tied.

So, I give up: please tell us what the difference is between a Woman (option #1) and a Latina (option #2)?

Being a transvestite or cross dresser has nothing to do with gender, and yes, everybody has a gender, so there is no issue there. Having an operation such as you listed still does not change the fact that a person has a gender.

This confusion is because the question mixes gender, race and religion. I thought the question was broken myself but than there is 5th answer "combination". The other answers have to be considered as "only" or "exclusive" meaning only one criteria fits. A "woman" than means only white/asian woman who are not jewish.

The population should be woman 52% African-American 20% Latina/o 15% Jewish 5%. Still a bitch for settlement.

Yes, the latina is a woman, and if so, she would fit two individual categories, so that would then invoke the combination, as notable explains... The individual choices have some overlap, which then requires the multiple choice option, that the question has partaken of.

I do not know that this makes the question difficult to settle fairly. It just requires people picking the choices to recognize that a woman candidate, does not necessarily mean the woman option will win.. It may mean the combination will win. ...

Perhaps a better way to clarify it, is that the "latina" option cannot win. If the person IS a latina, then neglecting the side issues of operations, dressing behaviors, etc. then she would also be a woman, hence the 2 or more option should be invoked, and presumably would win fairly! hope this helps.

OK "Latino/Latina" should be "Hispanic". The first four choices are, indeed, intended to mean "only".

If the person were Latina then options #1 and #2 would satisfy the question, and thus, option #5 would be the settlement

hfl13, those percentages may be for the population as a whole. Does anyone know the demographics for likely SCJ candidates? I suspect it's mostly old white guys. But there is a history of trouble on Hubdub for saying "old white guy."

of course, this, like a number of HD questions, illustrates how divisive (in terms of sex, religion, color, etc.) our world is becoming.

We care more about what "kind" of person is chosen, and not so much whether s/he is high quality, in terms of their education, etc.

I took option 2 to just mean of Latino race and not to be inclusive of women. If a Latino woman was the nominee then that would be a combination only -- this is the reason I hedged my bet on this.

When Ruth Buzzy Ginsburg or Paul Stevens retires I will make sure the options say "A woman and none of the other choices here other than 'Other' ", "Hispanic and none of the other choices here other than 'Other' ", etc.

With his first pick for the Supreme Court, President Obama made history this morning -- nominating someone who would be the first Hispanic and third woman on the high court.

But in choosing Sonia Sotomayor to replace the retiring David H. Souter of New Hampshire, Obama also played it somewhat safe -- like the nine current justices, she is a federal appeals court judge.
