Will 2009 or 2010 US 1040 Income Tax Forms Recognize States' Legal Same-Sex Marriages?
Background: Currently, the Fed's IRS forces same-sex couples who are considered legally married in and by their home state governments to LIE on their federal income tax forms because they must check "single" on the 1040 form. On the couple's STATE tax forms, however, they are required to check "married" since... well... they ARE.
This forces legally married same-sex couples to sign their federal forms "swearing" that they are single (and presumably committing perjury when they do so because that signature affirms that they are telling the truth) when in fact they are neither telling the truth nor single!
Will the federal government and/or the IRS change this policy, allowing legally married same-sex couples to legally check the "married" box on their 2009 or 2010 income tax forms?
This issue would be considered settled "yes" if the change is allowed for 2009 tax forms. Otherwise, it would be considered settled either way by April 14, 2011.
