Background: Did the brain of a deceased 88-year-old Michigan woman belong to her family?

A federal appeals court says state law is unclear. On Friday, it invited the Michigan Supreme Court to take up the issue in a lawsuit filed against the Oakland County medical examiner.

Katherine Weins' brain was removed during a 2006 autopsy, which was performed because there were suspicions about her death at a nursing home. It was incinerated as medical waste and not included when the body was released to her family for cremation.
