The premier was busy with a global food summit in Rome and did not attend the hearing in a Milan courtroom. His lawyers said Berlusconi is unavailable for the trial due to his engagements as premier until Jan. 18.

Italy's highest court has overturned a law granting Prime Minister Silvio Berlusconi immunity from prosecution while in office. The Constitutional Court annulled the law, which had allowed him to withdraw from several cases. In one he was facing corruption charges. Opponents say immunity violates the principle that all citizens are equal. A spokesman for Mr Berlusconi said the verdict was "politically motivated" and insisted he would not resign.

Berlusconi says he is 'most persecuted man in history'

Italian Prime Minister Silvio Berlusconi claimed Friday to be the most persecuted man anywhere in history at the hands of the courts, after judges quashed his immunity from prosecution.

But he said his centre-right government would carry on with massive public backing and there was no need to organise demonstrations in his favour.

"I am absolutely the person the most persecuted by the judiciary of all times, in all history and of anywhere in the world," he told journalists on emerging from a cabinet meeting.

Berlusconi said he had made more than 2,500 court appearances and spent more than 200 million euros on his defence in the various legal cases against him.

He is accused of tax fraud and false accounting in the purchase of TV rights by Mediaset and of bribing British lawyer David Mills to give false testimony to protect his business empire. Berlusconi denies any wrongdoing.

ROME -- The trial of Italian Prime Minister Silvio Berlusconi for alleged tax and accounting fraud will resume in mid-November, thrusting the media tycoon into a legal battle as he faces the task of pulling Italy's economy out of recession. A Milan judge on Monday informed Mr. Berlusconi's lawyers that a hearing for the trial was scheduled for Nov. 16, according to Piero Longo, one of Mr. Berlusconi's lawyers.

The trial is the first legal proceeding to be revived against Mr. Berlusconi since Italy's Constitutional Court this month struck down a law that shielded him, as a sitting prime minister, and other top Italian officials from criminal prosecution. The trial was suspended in 2008 after Mr. Berlusconi's center-right allies passed an immunity law in Parliament.

A quick note on the timeline of this market. When this question was first created, Silvio Berlusconi still enjoyed full immunity and it wasn't until October 7th that his immunity was repealed making prosecution a possibility. If I read this question correctly it's asking if Berlusconi will ever be prosecuted (and not necessarily convicted) so as such, shouldn't this market settle as YES because his trial has already begun?

Here's the timeline:

September 7 - Question created

October 7- Berlusconi loses immunity protections

November 16 - Berlusconi trial begins and was adjourned until January 18th 2010.
